BY PLACING AN ORDER YOU ACCEPT THESE TERMS OF SALE
By placing an order on the Website, you confirm that you accept these Terms of Sale and agree to comply with them.
If you do not agree to these Terms of Sale, you must not place an order.
We recommend that you retain a copy of these Terms of Sale for future reference.
These Terms of Sale refer to additional terms and policies which also apply to your purchase of products, including:
-
our Privacy Policy, which explains how we collect, use and store your personal data; and
-
our Cookie Policy, which sets out information about the cookies and similar technologies used on the Website.
CHANGES TO THESE TERMS OF SALE
We may update or amend these Terms of Sale from time to time and will post the updated version on the Website.
Every time you wish to make a purchase, please check these Terms of Sale to ensure that you understand the terms that apply to your purchase at that time.

PRODUCT DESCRIPTIONS
All images of products shown on the Website are provided for illustrative purposes only.
A product's colour, texture, dimensions or appearance may not exactly match the image displayed on your device or other marketing materials.
Product descriptions and information provided on the Website are for general information purposes only. They are not intended to constitute professional or specialist advice.
You should obtain appropriate professional or specialist advice before taking, or refraining from taking, any action based on information contained on the Website, a product or its packaging.
All products should be used strictly in accordance with their instructions, precautions and guidelines.
You should always check the ingredients and other product information before use, particularly if you have allergies, sensitivities or other relevant conditions.
Nothing in these Terms of Sale affects your statutory rights or any legal guarantee of conformity that applies to products supplied to you.
HOW TO PLACE AN ORDER
You must be 18 years or over to place an order on the Website.
You place an order by following the purchasing process on the Website.
This will generally involve:
-
selecting the product or products you wish to purchase and adding them to your basket;
-
reviewing your basket, including applicable delivery charges;
-
entering any applicable promotional code or other discount;
-
proceeding to checkout;
-
entering your delivery and billing information;
-
selecting your available payment method; and
-
submitting your order using the relevant order and payment button.
By clicking the relevant order and payment button, you submit an order to purchase the products and acknowledge that the order carries an obligation to pay.
We reserve the right to limit the number of a particular product that may be purchased by an individual customer where we consider this reasonably necessary.
We may also suspend or restrict an account where we identify unusual, fraudulent or suspicious activity, including unusual patterns of returns or orders.
Where this happens, we may contact you using the details associated with your account or order.
OUR CONTRACT WITH YOU
After you place an order, we will send you an order confirmation email setting out details of the products you have ordered.
This email confirms that we have received your order but does not necessarily constitute acceptance of your order.
Our acceptance of your order and the completion of the contract between you and us will generally take place when we dispatch the products to you, unless we notify you that we are unable to accept your order.
You will receive a dispatch confirmation when your products are dispatched, where applicable.
If we are unable to accept your order, we will inform you and will refund any payment you have already made for products that we cannot supply.
This may be because:
-
the product is out of stock;
-
there is an error in the price or product description;
-
the order raises an issue relating to legal or regulatory compliance;
-
our fraud or security checks identify an issue;
-
we are unable to obtain payment authorisation; or
-
circumstances outside our reasonable control prevent us from fulfilling the order.
We are not required to provide a detailed reason for rejecting an order unless applicable law requires us to do so.
The contract will be concluded in English.
We will retain a copy of your order and relevant contract information in accordance with our legal and business requirements.
PRICE AND PAYMENT
We reserve the right to change our prices at any time.
If the price of a product changes after you have placed an order, the price applicable to your accepted order will not generally be affected.
All prices shown on the Website are in pounds sterling (£), unless otherwise stated, and include VAT where applicable.
Delivery charges and any other applicable charges will be displayed during the ordering process before you submit your order.
If the applicable rate of VAT changes between the date of your order and the date we supply the product, we may adjust the VAT element of the price where permitted by law.
Products remain our property until we have received payment in full, to the extent permitted by applicable law.
During checkout, you will be required to provide the payment information requested.
We accept the payment methods displayed on the Website at the time you place your order.
All card payments are subject to authorisation by your card issuer and/or payment provider.
If payment is not authorised, we may cancel the order and notify you.
If you have already received the products and payment is subsequently reversed or remains unpaid, you must return the products to us as reasonably requested.
CHANGES TO PRODUCTS
We may make reasonable changes to products, including changes to formulation, packaging, labelling or presentation, where necessary to reflect changes in applicable laws, regulations, safety requirements, manufacturing processes or other legitimate business requirements.
Any such changes will not affect your statutory rights.
PRODUCT DELIVERY
Information about available delivery options, costs and estimated delivery times will be displayed on the Website.
We will endeavour to deliver products within the estimated delivery period stated at the time of purchase.
Unless otherwise agreed or permitted by law, products will be delivered no later than 30 days after the date on which the contract between you and us is formed.
Delivery will be made to the address specified in your order.
If nobody is available to receive the delivery, the delivery carrier may attempt delivery again, retain the products for collection, or leave the products in a designated safe place where this option is available and has been selected by you.
Where you choose a safe place, you are responsible for ensuring that the location is suitable and secure.
Our delivery partners will use reasonable efforts to follow your delivery instructions, but we cannot guarantee that instructions will always be followed in every circumstance.
If products are returned to us because delivery cannot be completed, we may refund you in accordance with our Returns Policy and applicable law.
Risk in the products will pass to you when the products are delivered to you or to a person nominated by you to receive them, subject to applicable consumer law.
We are not responsible for delays caused by circumstances outside our reasonable control.
If an event outside our reasonable control causes a substantial delay, we will contact you where reasonably possible and take appropriate steps to minimise the effect.
Where legally permitted, you may have the right to cancel the contract if a substantial delay occurs.
CANCELLING YOUR ORDER OR CONTRACT
You may have a statutory right to cancel your contract within 14 days after receiving your products under the Consumer Contracts Regulations 2013, subject to applicable exceptions.
Your cancellation rights are in addition to any other statutory rights you may have.
If you wish to exercise your statutory right to cancel, you should notify us clearly of your decision within the applicable cancellation period.
You may contact RUM using the customer service contact details provided on the Website.
You should provide:
-
your name;
-
delivery address;
-
order number or details of the order;
-
details of the products you wish to cancel; and
-
your contact details where necessary.
You must take reasonable care of products while they are in your possession.
Where you cancel a contract, you must return the relevant products to us within the period required by applicable law.
Unless otherwise stated in our Returns Policy or required by law, you may be responsible for the direct cost of returning products when exercising a statutory cancellation right.
We will process refunds in accordance with applicable law and our Returns Policy.
Where required by law, refunds will include the applicable standard delivery charge originally paid by you.
We are not required to refund any additional cost arising because you selected a more expensive delivery method than the least expensive standard delivery option available.
Certain products may be excluded from cancellation rights where permitted by law, including products which are sealed for health or hygiene reasons and have been unsealed after delivery.
RETURNS, EXCHANGES AND REFUNDS
We hope you are happy with your purchases.
If you need to return or exchange a product, please refer to our Returns & Exchanges Policy for information about the applicable process and requirements.
Nothing in our Returns & Exchanges Policy limits or excludes any statutory rights you may have.
INTELLECTUAL PROPERTY RIGHTS
We are the owner or licensee of the intellectual property rights in our products, packaging, Website and related materials, except where stated otherwise.
These rights are protected by copyright, trade mark and other intellectual property laws.
All such rights are reserved.
LIMITATION OF LIABILITY
We do not exclude or limit our liability where it would be unlawful to do so.
This includes liability for:
-
death or personal injury caused by our negligence;
-
fraud or fraudulent misrepresentation;
-
breach of your statutory consumer rights; or
-
any other liability which cannot lawfully be excluded or limited.
Where permitted by law, our products are supplied for domestic and private use.
We will not be responsible for business losses, including loss of profit, loss of business, business interruption or loss of business opportunity, where the products are used for commercial or business purposes.
Nothing in these Terms of Sale affects your statutory rights.
PRIVACY AND PERSONAL INFORMATION
Our use of your personal information is governed by our Privacy Policy and Cookie Policy, which form part of these Terms of Sale by reference.
Please review those policies for information about how we collect, use, share and protect your personal data.
We do not sell your personal data to third parties.
We may share personal data with third parties where necessary to provide our products and services, including service providers processing information on our behalf, where you have provided consent, or where otherwise permitted or required by applicable law.
GENERAL
If any provision of these Terms of Sale is found to be unlawful, invalid or unenforceable, that provision will be treated as severable and the remaining provisions will continue in full force and effect.
Any delay or failure by us to exercise a right under these Terms of Sale will not constitute a waiver of that right.
These Terms of Sale constitute the agreement between you and us concerning the sale and purchase of products through the Website, subject to any other terms expressly incorporated into them.
These Terms of Sale are between you and us. No third party shall have rights to enforce them except where applicable law provides otherwise.
These Terms of Sale are governed by English law.
The courts of England and Wales will have non-exclusive jurisdiction, although if you are a consumer, you may also have rights to bring proceedings in the courts of the country in which you reside.
